All stationary textile, fashion and shoe stores have been closed for two months, but rent often continues unchanged as a large cost item. With the addition to the introductory law to the Civil Code, which came into force at the end of December, it was made clear in the new Section 7 in Art. 240 that a serious change in the basis of the transaction within the meaning of Section 313 of the German Civil Code (BGB) exists if rented commercial premises as a result of a government measure to combat Covid -19 pandemic can only be used for the tenant's business with restrictions.
This means: Tenants should, if necessary, renegotiate about adjusting the rental agreement.
